These Terms of Use constitute an agreement between NOMOBO, Inc. ("NOMOBO," "we," "us", or “our”) and you, the user. BY ENTERING, ACCESSING, BROWSING, SUBMITTING INFORMATION TO, OR OTHERWISE USING OUR PRODUCT OR SERVICES, YOU AFFIRM THAT YOU ARE ABLE AND LEGALLY COMPETENT TO AGREE TO THESE TERMS OF USE, AND THAT YOU DO AGREE TO THESE TERMS OF USE. THESE TERMS OF USE INCLUDE PROVISIONS RELATING TO BINDING ARBITRATION, WAIVER OF A RIGHT TO JURY TRIAL, WARRANTY DISCLAIMERS, AND CERTAIN EXCLUSIONS AND LIMITATIONS ON OUR LIABILITY. If you do not agree to these Terms of Use, or if you are not legally competent to agree to them, then you may not use our product or any services offered.

These Terms of Use apply to your use of NOMOBO underarm rinse ("the Product"), which is produced and sold by NOMOBO, Inc. The Product is designed to keep you fresh and is intended for personal use in accordance with the instructions provided.

Your purchase and use of the Product constitutes your agreement with us to be bound by these Terms of Use. We may terminate your right to use the Product if you violate these Terms or use the Product for unlawful purposes.

Any software that is made available to download from the Services ("Software") is the copyrighted work of NOMOBO, Inc. and/or our suppliers. Your use of the Software is governed by the terms of the end user license agreement, if any, which accompanies or is included with the Software.

Use of the Service may be available through a compatible mobile device, Internet and/or network access and may require software. You agree that you are solely responsible for these requirements, including any applicable changes, updates, and fees as well as the terms of your agreement with your mobile device and telecommunications provider.

16. OPERATION OF THE SERVICE - DISCLAIMER

NOMOBO, Inc. does not guarantee that the Service will be uninterrupted or error-free, and does not warrant the accuracy, reliability, or currency of any information, content, service, or merchandise provided through the Service. We reserve the right to correct any errors, inaccuracies, or omissions and to change or update information at any time without prior notice.

17. LIMITATION OF LIABILITY

NOMOBO, Inc. shall not be liable for any direct, special, incidental, consequential, or punitive damages resulting from the use or inability to use the Product, even if we have been advised of the possibility of such damages.

The laws of certain jurisdictions do not allow limitations on implied warranties, or the exclusion or limitation of certain damages. If these laws apply to you, some or all of the above disclaimers, exclusions, or limitations may not apply to you, and you might have additional rights.

19. Indemnification

You agree to indemnify and hold harmless NOMOBO, Inc., its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including attorneys' fees) related to your violation of these Terms or use of the Product.

20. Copyright Agent

NOMOBO, Inc. respects the intellectual property of others, and we ask our users to do the same. If you believe that your work has been copied in a way that constitutes copyright infringement, please provide our Copyright Agent with the written information specified below:

• A description of where the material that you claim is infringing is located on the Service;
• Your address, telephone number, and e-mail address;
• A statement by you that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law;
• A statement by you, made under penalty of perjury, that the above information in your notice is accurate and that you are the copyright owner or authorized to act on the copyright owner's behalf.

21. Applicable Law; Jurisdiction

These Terms of Use shall be governed by and construed in accordance with the laws of the state of Wyoming where NOMOBO, Inc. is incorporated, without giving effect to any principles of conflicts of law.

If any provision of these Terms is deemed unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from these Terms and shall not affect the validity and enforceability of any remaining provisions.

23. No Waiver

No waiver by NOMOBO, Inc. of any term or condition set forth in these Terms of Use shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition, and any failure of NOMOBO, Inc. to assert a right or provision under these Terms of Use shall not constitute a waiver of such right or provision.

24. No Legal Effect

The section titles in these Terms of Use are for convenience only and have no legal or contractual effect. This agreement is binding and will insure to the benefit of NOMOBO, Inc.'s successors and assigns.

25. Legal Notices & Electronic Communications

Except as explicitly stated otherwise, any legal notices shall be given to NOMOBO, Inc. at our registered office via certified mail, and to you at the email address you provide to us during the registration process. Notice shall be deemed given 24 hours after an email is sent, unless the sending party is notified that the email address is invalid.

26. Ecommerce Terms

The purchase of NOMOBO products through our website is subject to additional ecommerce terms, including order acceptance, prices, product descriptions, risk of loss, and user transactions as outlined above.

27. Refund Policy

If you wish to request a refund, you must email support@nomoborinse.com. A refund will be provided within 7 business days of the request.

28. No Chargebacks

By purchasing NOMOBO products, you agree not to initiate any chargebacks with your credit card company or bank. Any disputes regarding charges must be settled directly with NOMOBO, Inc.
